I paid off my house but now have charged up $125,000 in home equity against our home with interest only payments until 2014. House is worth $300,000. Should we convert to a mortgage or an equity program that includes pricipal payments? or someting else? any ideas? And when is the best time?

Dear Robert,

I have sent my paycheck stub and everything Vericrest wanted me to for a modification due to my husband of 23 years walked out on me and my three girls and left us with nothing. i have lived in the house for 17 years before he left us homeless due to him not making our house payments.

I have gotten back on my feet again in the past year and I have a good job and my girls and I need a stable environment to live in. if you could please help me in any way my girls and I would love it. this is a neighborhood that all my children's friends live in and I really had great neighbors. Please contact me as soon as possible.

From James Robert Deal:

I cannot represent clients outside of Washington unless you have a sponsoring attorney there in Florida where you are.

A bankruptcy attorney is more likely to understand these issues. Or Google for "mortgage modification attorney Florida" or "foreclosure defense attorney Florida".

I'm in a chapter 7 bankruptcy and I have a loan with Vericrest Finanical (They bought it from Flagstar in Dec 2010). I have not made a payment on my mortgage since early 2010 and I was about to be foreclosed on. I brought in an agency to help me with a short sale. But through a mis-communication, my Chapter 7 bankruptcy was filed and that put a stay on any short sale proceedings we had (we even had a buyer).

Now, as I'm waiting for my Ch 7 to be discharged (I just appeared in court on 3/25), I'm wondering if there's ANYTHING I can do with my 1st mortgage to modify it using the federal HAMP program and/or the California "Keep your Home" programs? I had a second loan on the house for a much smaller amount from GreenTree.

The house was being short-saled for $360k. I am currently mortgaged (1st and 2nd) for $540k. I last re-financed the house in 07, right before the market dropped out from beneath us.

I got a divorced in early 08 and well, the rest is history.

I'm just wondering if there's ANYTHING I can do? I'm self-employed, I make 90-100k a year, and I'm about to rent a house for the same amount as what I would pay if I could just modify this loan, and get rid of the huge back payments they want me to make in one lump sum -- I don't have $40,000 sitting around or I wouldn't have had to file for bankruptcy.

I've begun researching the possible programs I qualify for but it's all so very confusing and time consuming. I'm a consultant and I have to provide my clients with service or I don't get paid.

Thank you for your time.

Steve,
Thanks for your comment and thanks for your visit last week. I will be working with you. Your property is significantly underwater. Your loan amount is just barely under the $729,750 maximum for a Making Home Affordable modification, and your income level is right. So I am optimistic that I can win a modification from you. I look forward to working with you.

Dear Robert,

I have been on repayment plan with First Horizon($5,850 per month). Every year they need to redo the repayment plan, which I’ve done twice, and it took a couple of months each time to do. I have supplied them with everything they needed in June 2010 and again in December 2010. Our income, bank balances, and financials have increased for the last three years and yet we get a letter last week stating we were temporarily denied, because we didn’t supply all the info they needed. Not true. The letter was dated 12/30/2010 and that we needed to respond within 10 days. I opened the letter 1/13/11. So I called immediately and I explained to the representative from F.H., that I have been checking on status at least 3 times a month since June 2010. She said let’s just start over and she would send a new packet.

Yesterday taped to our door was a Notice of Trustee Sale. The sale date is 4/15/2001, at 10:00.

Are you able to do anything, other than a Chapter 13? Our assets are too much to do a chapter 11. Are we in a position to still do a loan modification? We have good cash flow, of which don’t quite understand what they’re doing to me, outside of being stuck in a jumbled up bureaucratic quagmire.

Time is important for us. We're gone from 1/20/11-2/3/11.
