The standard real estate forms that every buyer and seller signs advises the buyer or seller to consult with an attorney before signing them. But most buyers and most sellers do not do this. Why?
The buyer or seller might regarding this as an expense he or she can avoid.
The buyer or seller might feel that he or she can wait to hire an attorney if a legal issue arises. The trouble with this is that by the time you suspect you have a problem, it might be too late to avoid or fix the problem without cost to you.
First and foremost, real estate brokers to not encourage buyers and sellers to seek independent legal counsel and sometimes discourage it. There are practical problem with attorneys. A lot of attorneys do not know the practical side of real estate, and they can actually give overly cautious and incorrect advice. Attorneys often do not work nights or on weekends, and delays can mean deals will fail.
